Through using the service Norton Top Search Result, users (below the ”Customers”) may control their top search result on Google sevrches. The service functions by way of providing the Customer with the top search result as an Adword-ad which can be modified in accordance with the desires of the Customer and the service is provided until such time when five (5) clicks have been made on the link in the Adword-ad. Norton Top Search Result uses the Google Adwords service which is provided by Google which is the creator and provider of ”Adwords”.
Norton Top Search Result (below the ”Service”) is provided free of charge and until further notice to Customers by Symantec Nordic AB (below ”Symantec”).
The purpose of these general terms & conditions of use (below the ”Terms”) is to define the terms and conditions under which Customers may access and use the Service.
Any Customer accessing and using the Service accepts these Terms and agrees to comply with them. By using the Service, the Customer represents and warrants that he or she is (i) at least 18 years of age and (ii) is of sufficient capacity to enter into a contract. The service is available in the Nordics (Sweden, Norway, Finland, Denmark).
In registering for and accessing the Service, the Customer further represents, warrants and undertakes that (i) the information provided by that Customer to Symantec is true and accurate so as not to mislead Symantec, (ii) the Customer will be not be violating any applicable law or regulation, including privacy regulations, and (iii) the Customer will not infringe any copyright, patent, trade mark or any other intellectual property rights of a third party, (iv) Customer has all necessary rights to permit and hereby grants Symantec and Google Inc., a U.S. entity with address: 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA, (below ”Google”) all such rights which are necessary for Symantec and Google to (as applicable) use, host, cache, route, store, copy, modify, distribute, reformat, reproduce, publish, display, transmit and distribute Customer's ad(s) (v) the information provided by that Customer to Symantec is not harmful, abusive, obscene, threatening or defamatory, and (vi) when using the Service Customer is compliant with Google advertising principles as posted on Google Adwords Policy center website.
2. Accessing and utilizing the Service
The process for accessing the Service is as follows:
The Customer must access the webpage: www.norton.com/topsearchresult where it is possible to sign up for the Service (below the ”Site”) through filling out the requested information while ensuring that it is accurate and complete. This will create an account for the Customer. It is strictly forbidden to create an account for another person unless such person is a minor (under 18 years of age) and the person creating the account is the parent or legal guardian of said person.
The Customer must fill out his/her full name along with such search words as might be necessary to identify the Customer as well as the desired header and description for the Adword-ad, thereafter the Customer may select his or her desired URL which will be displayed as the top Google search result in the Service. The Customer may in this respect choose either a Google link or his/her Facebook, Twitter or LinkedIn account URL.
The Customer is allowed a preview of the final result and may thereafter choose to accept the result, create an account and start using the Service. This is done through the Customer entering his/her desired email (for accessing the account), choosing to unconditionally accept these Terms in full and finally through logging on to his/her Facebook account and thereby verifying his/her identity for the purposes of the Service. The Customer is thereafter requested by Facebook to allow connection to Facebook via the Service which the Customer must accept in order for the creation of the account to be completed.
Symantec will then, in its absolute discretion, verify whether on the basis of the submitted information, the Customer meets the conditions for creating an account and using the Service.
If the above conditions are met, the Customer receives via email a confirmation of the activation of his/her account. The approval from Google can take a few days and the approval is necessary for the ad to be visible on Google. Thereafter, subject to these Terms, the Customer will be able to use the Service and change the Adword-ad shown as the top Google search result which is done through the process described above. For the avoidance of doubt, the Service does not include the option to change any other Google search results other than the top one.
Symantec shall provide the Service to the Customer until such time when, in Symantec’s choosing, either five (5) clicks have been made on the link in the Adword-ad and is thereafter, at all times, after having notified the Customers via email thereof in advance, entitled to cease providing / close down the Service without cause. Upon ceasing to provide / closing down the Service, Symantec will ensure that Customer accounts are terminated without the Customer being able to assume the account.
3. Security and access
The account log in and password for each Customer is strictly personal and confidential, and may not be used by anyone except the relevant Customer to which it belongs. Every Customer is personally responsible for log in and password and must therefore ensure its security and confidentiality.
In the event that a person (Customer or not) discovers an Adword-ad for him-/herself which he or she believes is inappropriate (for instance in the event that someone has managed to use his/her name to create an account along with an inappropriate picture) the person will have the option to click on a Symantec link in the ad which will lead to the Site. On the Site the person may use a report function to notify Symantec of the key search word which caused the ad. Symantec will then immediately and manually block the ad and notify the creator via email. In order for this function to work properly and be protected from abuse, the creator will have the option to create a new ad.
4. Loss of access to the Service
Symantec reserves the right, at any time and without prior notice, to block an ad, deactivate an account or block a Customer in its absolute discretion, including in circumstances where (but not limited to):
- the Customer has provided Symantec with inaccurate, false or otherwise misleading information at the time of registration;
- the Customer’s Facebook account has been blocked, deactivated or otherwise cancelled for whatever reason;
- the account information has been communicated to a third party or a third party has been allowed to access the Service using another Customer’s then current web session; or
- the Customer has made inappropriate, fraudulent or otherwise unlawful use of the Service.
In addition, due to the fact that the Service is provided free of charge, Symantec shall at all times and regardless of what is stated elsewhere in these Terms, after having notified the Customers via e-mail thereof in advance, be entitled to cease providing / close down the Service without cause.
5. Treatment of personal information
Treatment of personal information will take place in accordance with the Symantec data protection notice to be found on the Site.
Accessing the Service allows the Customer to make use of third party web sites or services for which the privacy policy may be different from Symantec’s. Each Customer must therefore review the privacy policy of these third party web sites or services, with the understanding that Symantec is not liable for the personal information processed, transferred or collected by any third party when visiting any third party web sites or using third party services.
6. Intellectual property rights
All intellectual property and other rights in the general structure of the Service, as well as the trademarks of Symantec and/or its group companies including the logos shown within the Service, any software programs, texts, animated or other images, technology and all other elements comprising the Service are the exclusive property of Symantec, group companies or its licensors (below the ”Content”). Save as expressly provided in these Terms, no Content may be copied, reproduced, modified, publicly displayed, used to create derivative works or distributed in any way for any commercial purposes. A Customer may not use any robot, spider, deep-link, page-scrape or any other automated device or manual process to monitor or copy any Content from the Service.
Symantec, the Norton from Symantec logo, Norton, the Checkmark in circle design, are trademarks or registered trademarks of Symantec Corporation or its affiliates in the U.S. and other countries. Other logos, brands and products are the trademarks of their respective holder(s).
7. Force Majeure
If and to the extent that Symantec’s performance of any of its obligations is prevented, hindered or delayed by a Force Majeure Event (as defined below), then Symantec will be excused for such non-performance, hindrance or delay, as applicable, of those obligations affected by the Force Majeure Event. For the purpose of the Terms, a ”Force Majeure Event” means fire, flood, earthquake, elements of nature or act of God, riot, civil disorder, rebellion or revolution, acts of war or terrorism, strikes, even when actions are taken against Symantec, and other similar cause beyond the reasonable control of Symantec.
8. Limitation of liability
To the fullest extent permitted by applicable law Symantec hereby disclaims any and all liability for loss, injury or damage (whether direct, indirect, consequential, incidental or special) arising out of or in connection with the use of the Service by a Customer (including any use or access of third party websites through the Service) or otherwise resulting from, without limitation:
- the accuracy, completeness, reliability, availability, suitability, quality, ownership, non-infringement, operation, merchantability and fitness for purpose of any content contained in or accessed via the Service;
- any acts or omissions of any third parties such as, without limitation, Google, LinkedIn, Facebook or Twitter in connection with a Customer’s use of the Service;
- any interruption, failure or cessation of operation or transmission of the Service; and
- resulting from reliance upon, operation of, use of or actions or decisions made on the basis of, any facts, opinions, ideas, instructions, methods, or procedures contained in or accessed via the Service.
9. Representations, warranties and guarantees
Symantec does not guarantee: (i) the placement, positioning or the timing of delivery of any ad, or (ii) the number (if any) of any impressions, publications, conversions or clicks on any ad advertised through the Service.
Symantec makes no representation or warranty that the Service will always function as intended and is therefore not liable for any loss, injury or damage which might arise as the result of the Service not operating as intended. Furthermore, Symantec is never liable for any actions or omissions of a third party in relation to the use of the Service.
Customers acknowledge and agree that Symantec has no control over any website or service owned or operated for or on behalf of a third party such as, but not limited to, Google, Twitter, Facebook or LinkedIn. Symantec therefore disclaims any and all liability or responsibility for any content or services provided on or through any such third party web site or service, or any Customers’ use or reliance on such content or services. Each such third party is responsible for its’ own web site and service. Hence, each third party may in its sole discretion determine who will be authorized to access its web site or services. The Customer acknowledges and agrees that Symantec is not involved in this decision and therefore Symantec shall not be held responsible for any Customer’s inability to access any web site or service of such a third party. In order to challenge any such web site or service access refusal, the Customer should therefore directly liaise with the relevant third party.
10. Changes to the Terms
Symantec shall have the right, at its sole discretion and at any time, to change or modify these Terms, such change shall be effective immediately upon posting to the Service. Customers are responsible for regularly reviewing these Terms to obtain timely notice of any such changes. Symantec will post a last amended date at the bottom of this page to assist such review. The continued use of the Service by a Customer after such posting shall constitute that Customer’s acceptance of these Terms as modified.
11. Miscellaneous
If any provision of the Terms is held by a court of competent jurisdiction to be unenforceable, then the remaining provisions of the Terms, if capable of substantial performance, will remain in full force and effect.
No delay or omission by either party to exercise any right or power it has under the Terms will impair or be construed as a waiver of such right or power. A waiver by any party of any breach or covenant will not be construed to be a waiver of any succeeding breach or any other covenant.
A Customer shall not assign the Terms or any of his/her rights or obligations hereunder without the prior written consent of Symantec. Symantec may freely and without informing the Customer thereof engage sub-suppliers for the provision of the Service, or parts thereof, to the Customer.
12. Complaints and disputes
Any complaints against the Service should be made to Symantec via the address [nordic_marketing_norton@symantec.com].
These Terms and any and all claims, disputes or proceedings of any kind (whether contractual or non-contractual) arising out of or in connection with them shall be governed by and construed in accordance with Swedish law. Customers irrevocably submit to the exclusive jurisdiction of the applicable Swedish district court in respect of all proceedings arising out of these Terms (whether contractual or non-contractual).
